The present general conditions of sale are concluded between the SAS TGA located 74 rue Louis Rustin, 74160 Archamps, with the Social Capital of 6 000 €, registered with the Trade and Companies Register of Lyon under the number 884 147 141, represented by M. Kielwasser, as president, duly authorized for the purposes hereof, named THE GIN ADDICT on the one hand, and the natural or legal person proceeding to the purchase of products or services of the company, hereinafter, “the Buyer”, or “the Customer” on the other hand.
The following has been stated and agreed upon:

ARTICLE 3: GENERALITIES
Any order placed by a buyer on the Online Shop is subject to these General Terms and Conditions of Sale to the exclusion of any other document, in particular the buyer’s general terms and conditions of purchase
All clauses and conditions contrary to these General Terms and Conditions of Sale appearing on order forms and more generally on any type of correspondence from the buyer will be deemed unwritten and will have no contractual value between the parties. The present General Conditions of Sale can only be derogated from by express written agreement of THE GIN ADDICT.
The products are described by the information on the data sheets.
The information given in the catalogs, prospectuses, advertisements, notices or other documents of THE GIN ADDICT are given only as an indication and do not engage THE GIN ADDICT which can modify them at any time.
The photographs of the product sheets are only given as an illustration, it is possible that the product differs from what is displayed. The information provided in the photographs is not binding on THE GIN ADDICT, which may modify it at any time.
THE GIN ADDICT reserves the right to correct any inadvertent clerical error or omission in these Terms and Conditions, as well as in any other contractual document.
ARTICLE 4 : ORDERING
All orders must be placed through the Online Store by clicking on the “Pay Now” button. The order is firm only when the buyer has successively filled in the mandatory information under the headings “Identification”, “Enter your details”, “Choice of transport” and “Choice of payment method”.
The order is confirmed by THE GIN ADDICT by sending an email to the buyer.
Any order on the Online Shop implies the acceptance without reserve of the present General Terms and Conditions of Sale, which the buyer acknowledges having read prior to placing the order.
The buyer agrees to be at least eighteen years old at the date of the order.
In the event of non-compliance with the present Conditions by the buyer, THE GIN ADDICT reserves the right to cancel all or part of the orders in progress or to suspend the deliveries of goods.
ARTICLE 5: PRE-ORDER
The buyer can, in certain cases, pre-order a product on La Boutique en Ligne that is not yet available for sale in order to reserve it for the day of its official release.
By “Pre-order(s)” is meant the products indicated as such on their product sheets and which can be reserved on the site before their release.
The said product is then delivered to the buyer, according to the terms chosen by the latter, under the conditions set out in Article 9 of the General Conditions of Sale.
If, exceptionally, the pre-order cannot be honored by THE GIN ADDICT, the buyer will be fully refunded of the amount paid, by bank transfer and without any additional cost for the buyer.
The date of arrival in stock communicated by the supplier of a product is only indicative, the responsibility of THE GIN ADDICT cannot be committed in case of delay compared to the date initially communicated to the buyer.
ARTICLE 6 : AVAILABILITY OF STOCKS
The products are delivered within the limits of available stocks.
In case of unavailability of the ordered product, THE GIN ADDICT informs the buyer and can offer him a product of an equivalent quality and price or, failing that, a credit note for the amount of the order usable on the Online Shop.
In case of disagreement of the buyer, THE GIN ADDICT proceeds to the refund of the sums paid within fourteen days.
ARTICLE 7 : VALIDITY OF THE ORDER
THE GIN ADDICT reserves the right to refuse any order for legitimate reasons and more particularly in the case where the quantities ordered, by means of one or more orders, are abnormally high compared to the quantities usually ordered by the buyers in their capacity as consumers.
THE GIN ADDICT reserves the right to ask the buyer for additional guarantees of identity and payment for any order over 2000€.
ARTICLE 8 : PRICES
The buyer is bound by an obligation to pay the price at the time of the order on the Online Shop.
The prices of the products are indicated in Euros, including all taxes, but excluding delivery costs, which are indicated on the online store.
The prices invoiced for the products are those appearing on the Online Boutique on the date of confirmation of the order by the buyer.
THE GIN ADDICT reserves the right to modify the prices in force on the Online Shop at any time. The price change will be automatically applicable on the date of publication of the price change on the Online Shop.
All orders, regardless of their origin, are payable exclusively in Euros.
ARTICLE 9: PAYMENT
The buyer has the possibility of proceeding to the payment of his order by the intermediary of various methods which are the following ones:
– by credit card (Visa, Mastercard, American Express) or through the online services offered by PayPal or Apple Pay
THE GIN ADDICT reserves the right to modify the available payment methods at any time.
ARTICLE 10 : RIGHT OF WITHDRAWAL OF THE BUYER
a ) RIGHT OF WITHDRAWAL
The buyer has a period of fourteen (14) days following the receipt of the order to exercise his right of withdrawal, without having to justify a reason.
In order to exercise the right of withdrawal, the buyer must notify his decision in a clear and precise statement, free of any ambiguity.
The declaration of withdrawal must include the following information: name of the buyer, geographical address and, if applicable, telephone number and e-mail address. If the product was received by a third party other than the purchaser, the latter must indicate the contact details of this third party in the declaration of withdrawal.

Upon receipt, THE GIN ADDICT will communicate to the buyer, without delay, an acknowledgement of receipt of the withdrawal on a durable medium.
The right of withdrawal cannot be exercised for products that have been opened.
- EFFECT OF THE WITHDRAWAL In case of exercise of the right of withdrawal by the buyer, THE GIN ADDICT will reimburse to the buyer the totality of the sums paid at the latest fourteen (14) days from the receipt by THE GIN ADDICT of the decision of the buyer to withdraw, in accordance with the provisions of article 15 b) below.
The refund does not include the standard delivery charges as proposed at the time of ordering by THE GIN ADDICT. Delivery costs are not refunded by THE GIN ADDICT.
The refund will be made using the same means of payment as the one used by the buyer for the order, unless the buyer and THE GIN ADDICT agree to use another means of payment.
The buyer undertakes to return the products received without delay, if necessary no later than fourteen (14) days from the notification of the declaration of withdrawal to THE GIN ADDICT. The withdrawal will only be effective after the products have been returned to THE GIN ADDICT before the expiration of the fourteen (14) day period.

The cost of returning the products is the responsibility of the buyer.
- BUYER’S RESPONSIBILITY
The responsibility of the buyer is engaged in case of depreciation of the product or its packaging resulting from manipulations other than those necessary to establish the nature, characteristics and good condition of the product.
b ) RETURN AND REFUND FOR NON-CONFORMITY:
In case of delivery to the buyer of a non-conforming or defective product, the buyer may return the said Article within fourteen (14) days after receipt of the delivery to THE GIN ADDICT by following the procedure provided below and accessible on the Site.
The buyer must notify his intention to return an Item by e-mail to THE GIN ADDICT’s customer service via the Site.
In order to benefit from the refund, the Customer will proceed to the return, in the original packing of the Articles, to the following address

The refund includes the standard delivery charges as proposed at the time of ordering by THE GIN ADDICT. The refund will be made using the same means of payment as the one used by the Buyer for the order, unless agreed between the Buyer and THE GIN ADDICT for the use of another means of payment.
Once the verification of the returned Items has been carried out, THE GIN ADDICT undertakes to refund the Buyer as soon as possible, to the bank account or payment account of the Buyer used for the payment of the Items.
ARTICLE 11: PRODUCT WARRANTY
The products sold correspond materially to the specifications presented to the buyer by the Online Shop when they are used in strict conformity with the functions for which they were sold. Unless otherwise provided by law, the liability of THE GIN ADDICT shall in no case exceed the value of the goods invoiced.
ARTICLE 12: INTELLECTUAL PROPERTY RIGHTS
The www.the ginaddict.com website and each of its components (such as trademarks, domain names, texts, tree structures, software, animations, images, photographs, illustrations, packaging, diagrams, logos, sounds and music) are the exclusive property of THE GIN ADDICT or of third parties who have duly authorized THE GIN ADDICT to use these components, which alone is entitled to use the related intellectual property rights.
No element of the site may be used, reproduced, distributed or published in whole or in part without the prior written permission of THE GIN ADDICT.

ARTICLE 18: NO TACIT WAIVER
The fact that one of the Parties, at any time whatsoever, does not exercise a prerogative granted to it by these General Terms and Conditions of Sale, in particular not to proceed to the termination of the sales contract or to exercise this prerogative with delay, or not to demand the execution of any stipulation of the General Terms and Conditions of Sale, shall not be interpreted as an express or tacit waiver by this Party, neither to the right to exercise the said prerogative in the future, nor to its right to demand the scrupulous execution of the commitments subscribed by the other Party to undertake any action or claim which it could have in relation to the non-execution of its obligations by the other Party, nor possibly to its right to terminate the present contract for any violation of the same nature or of a different nature.
ARTICLE 19: APPLICABLE LAW – COMPETENT JURISDICTIONS
The present general conditions are exclusively governed by French law, to the exclusion of any other law, in particular the Vienna Convention of 11 April 1980 on the international sale of goods.
